We travel to Chester, arriving Chester Zoo approximately 10:30. The remainder of the day will then be at leisure in Chester Zoo to explore this fantastic attraction and see all the wonderful animals. We depart Chester Zoo this afternoon at 17:00 and begin our return journey home to North Wales.

The allegations laid out in a painstakingly detailed 61-page criminal complaint and affidavit were that the couple, Rendell A. Hoagland and Cindy Marie Warren, beat and tortured young Malinda Hoagland over a period of years dating to 2021, when the family lived in northern Pennsylvania.

“The evidence shows that Malinda was regularly subjected to hours of physical punishment, deprived of sleep, and beaten when she failed to comply with the unreasonable demands of Warren and Hoagland,” stated Chester County Detective Bernard Martin, the lead investigator in the case in his affidavit.

In all, Martin wrote that “hundreds of videos” were recovered from phones and other devices depicting the abuse of the girl by both Hoagland, her biological father, and Warren, his live-in girlfriend. “Over 150 videos and still images were recovered depicting Malinda shackled to furniture and enduring physical abuse. Over 200 videos and images depict Malinda being subjected to forced exercise and physical punishment.”

The abuse came as punishment for such infractions as forgetting chores or homework, stealing food, failing to sit properly, and failing to continue with forced exercise, the affidavit states.

Hoagland and Warren had already been charged in May with attempted homicide, aggravated assault of a child, unlawful restraint, and conspiracy in the death. They were awaiting a preliminary hearing in August while investigators continued to look into the circumstances the child’s death.

The new charges were announced at a press conference at the county Justice Center, which in addition to de-Barrena-Sarobe was attended by Martin, Chief Detective Dave Sassa, West Caln Police Chief Curt Martinez, First Assistant District Attorney Erin O’Brien, who will lead the prosecution, and others, including members of Malinda Hoagland’s family, who wore matching black #JusticeForMalinda t-shirts.

The new set of charges filed against Hoagland and Warren now include murder of the first, second, and third degrees, kidnapping of a minor, involuntary servitude, endangering the welfare of a child, false imprisonment and conspiracy, as well as the other counts. There were more than 280 separate counts in the criminal complaint filed with Magisterial District Judge J. Timothy Arndt III of Honey Brook.

The couple were arraigned by Arndt Thursday and ordered held without bail. They were already incarcerated in Chester County Prison on $1 million bail.

The abuse that Malinda Hoagland suffered was captured on video at the home in West Caln the couple shared with her and Warren’s young son and included being chained to an air hockey table and other pieces of furniture while enduring grueling “exercise” routines while partially or fully unclothed.

The case raised questions about why child welfare investigators and officials with the Coatesville Area School District, where Malinda attended elementary and middle school, did not pick up on evidence of the abuse. But Martin wrote that Hoagland and Warren deliberately hid evidence of their abuse of the child, pulling her from school without excuse, making her wear makeup to hide bruises, and eventually pulling her from school and enrolling her in a cyber charter program in which she would appear via Zoom.

By filing first-degree murder charges against the couple, de-Barrena-Sarobe stated that his office will pursue a capital murder case against the couple, although he said that was not “set in stone” and would be formalized before trial after discussions with Malinda’s family. Among the aggravating factors that the prosecution would have to assert in doing so include a death committed by torture, as well as one committed in addition to another felony, such as involuntary servitude.

As part of that equation, investigators enlisted the help of Dr. Stephanie Anne Deutsch of Nemours Hospital for Children in Wilmington, Del., who the affidavit lists as a national expert in child torture. She found that the child “experienced particularly cruel, callous psychological maltreatment by Warren and Hoagland for years.” She noted how the girl experienced “profound emotional distress” evinced by tearful, desperate pleas to just “give her another chance” in the days before her death.

“The psychological impact on Malinda of Warren and Hoagland’s torture is a crucial element of the type of abuse endured by Malinda, which meets all aspects of the medical definition of torture,” Martin wrote.

The decision to seek the death penalty would come when the couple are formally arraigned in Common Pleas Court.

In 2009, Warren, 46, was been sentenced to three to seven years in state prison in 2009 in the Monroe County case of the assault on her son, who was 3 years old at the time of the incident. She was charged with endangering the welfare of a child in that 2007 case, after having escaped being charged with homicide in the earlier death of her 2 1/2-year-old stepson because she cooperated with investigators against her then-husband, McKinley Warren Jr., who was later sentenced to 25-to-50 years in jail.

At the time of her death, Malinda Hoagland’s family issued a statement about the case.

“There is no ‘how-to’ guide to navigate the alleged murder of a child – a sister, a granddaughter, a niece, or a cousin. The paternal family of Malinda Hoagland is grieving, questioning, and leaning on each other for love and support. We also acknowledge the impact that her death has on the communities she was a part of,” said Jamie Hoagland, Emily Lee and Abbey Hoagland in a statement provided on Friday through attorneys Alexandria Crouthamel and Tom Bosworth.

The attorneys are investigating the “full and complete timeline of what occurred here,” Bosworth told a reporter. This includes any possible “red flags” before Malinda’s death that were missed, or ignored by the county or her school. Any findings could become the subject of civil claims.

According to the affidavit in Malinda Hoagland’s death, West Caln township police and EMTs from the Westwood Fire Company were called to a home in the 200 block of Reid Road, not far from Hibernia Park, for the report of an unresponsive girl around 7:30 p.m. Saturday, May 4.

Hoagland, 52, told a 911 call taker that Malinda had struck a tree while riding her bicycle earlier in the day. But staff at Paoli Hospital, where the child was taken, reported that she had numerous injuries and medical conditions that were highly specific to physical abuse. She died at the hospital, with trauma surgeons there unable to save her life.

According to Martin, the staff told him and Chester County Detective Jonathan Shave that the girl’s emaciated physical condition “alarmed them and that (her) physical appearance should ‘not occur in this country.’” The girl weighed just 50 pounds when she was brought to the hospital. Her body was battered, the doctor said, with several past injuries healed but still apparent.

In their statements to police about the matter, the couple, who moved to West Caln from the Poconos in 2022, suggested that the girl’s injuries were the result of two accidents at the Yogi Bear Jellystone Camp Resort in Lancaster County, where the couple had brought Malinda and Warren’s 9-year-old son for a weekend trip. The first occurred when she collided with another child on a water slide, and the second when she crashed into a tree while on her mountain bike, they claimed

The injuries they described were a scrape on her chin, a bump on her head, and a cut on her nose. Those are light years away from what doctors told investigators they found when they examined Malinda at the hospital, however. Those injuries included fractures to both wrists and ankles, broken vertebrae, an injured liver, cuts and significant bruising on her face and chest, deformities to her legs,  and chest contusions.

She suffered multi-system trauma, circulatory and respiratory failure, and cardiac arrest leading to her death at 9:58 p.m.

When police searched the Reid Road home, they found security cameras in every room of the house, but none that contained internal memory cards. However, investigators were able to pull copies of videos from the cameras from Warren’s cellphone, which she had given them.

In his new affidavit, Martin described some of the more than 450 videos found on the phone, dating as far back as July 2023, as well as still images and texts between the couple describing their abuse. They include episodes where Hoagland and Warren are heard yelling at Malinda and telling her to perform physical tasks as punishment for misbehavior; several where Malinda is seen chained to a hockey table; one where she is seen sleeping on a bare floor while chained; one where she is shackled to a dresser; one where she picks at her hand and eats the skin; and the last one, taken on May 2, where Malinda is chained to a desk doing school work. (The couple had pulled her from East Brandywine Middle School school in 2023.)

In one video, dated Jan. 27, Warren is overheard telling the girl, “Keep moving and don’t look for breakfast or lunch tomorrow ‘cause you’re not getting it. And you won’t get dinner either ‘cause I’m not getting up.”

Another recorded Malinda responding to Warren’s insults by saying, “Please, I’m sorry. I know I can’t move, and I’m sorry.” She is also heard crying.

In the 2007 case in Monroe County, police arrested McKinley Warren Jr. on charges he beat his 3-year-old son and locked him in a bedroom for days. A concerned neighbor’s phone call led police to discover the boy, who a prosecutor said looked like “a prizefighter who had been through a title bout” when police saw him at the couple’s East Stroudsburg home in January 2007.

McKinley Warren eventually pleaded guilty to both abusing the boy and causing a head injury that led to the December 2000 death of his daughter, who was the boy’s half-sister. Warren was sentenced to 25 to 50 years in state prison for both crimes.

The location of Malinda Hoagland’s death in rural West Caln, and the alleged brutality of the girl’s abuse, immediately brought to mind the case of the last child to have been murdered in that township, 3-year-old Scotty McMillan, who was beaten to death by his mother and her boyfriend. The torture that “Scotty” and his older brother, who survived, endured at the hands of Gary Lee Fellenbaum III made headlines around the world.
